Housing Accountability Act Notice

Pursuant to California Government Code Section 65589.5(h)(6)(D)(ii), if an applicant provides a written notice indicating a local agency’s failure to cease a course of conduct undertaken for an improper purpose, allegedly in violation of California housing law, the local agency is then required to publicly post that notice on the local agency’s website and provide copies to specific individuals and the county clerk.

On August 4, 2025, the applicant for the 130-unit multi-unit development at 5115 Ogan Road, Carpinteria provided said notice to the City. The City provided a preliminary response to the applicant on August 8, 2025.  If you have any objections, comments, evidence, or concerns about the project or the applicant’s written notice, please submit them to bretm@carpinteriaca.gov by October 3, 2025. The City will consider all submitted materials and issue a written statement as required by Government Code Section 65589.5(h)(6)(D)(iii)-(iv) by November 2, 2025.

Proposed project: A 130-unit multifamily residential building, of which 26 units will be available for rent to low-income households. Units would be a mix of studio, 1-, 2-, and 3-bedroom units. The first three stories of the building would consist of a 128-space parking podium. The application is a “builder’s remedy” project pursuant to Government Code Sec. 65589.5. The applicant has proposed a lot split at this site to separate the currently developed portion of the parcel from the undeveloped portion, on which the multifamily building is proposed.
